Terms of Use
These terms are the agreement between you and TODO: имя владельца как в документах — оно попадёт в App Store ЕС по DSA, TODO: страна резидентства владельца (TODO: почтовый адрес для DSA и для обращений; домашний адрес будет опубликован Apple в ЕС), the owner of the mobile application Deck games collection (app.deckgames.decks). By installing or using Deck you accept them. If you do not accept them, do not use the app.
1. What Deck is
Deck is a card game app with two halves: you play card games against the computer, and you can build your own games out of blocks and pass them to other people. Rules of games in Deck are data, not code: a game is a document the app reads.
2. Your licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use Deck on devices you control, for your own non-commercial use. You may not sell, rent or sublicense the app, decompile or reverse engineer it except where the law expressly allows, work around purchase or access checks, or use the app to break the law.
3. Age
You must be at least 13 years old to use Deck, and at least 16 in countries where consent to processing personal data requires that age, unless a parent or guardian consents on your behalf.
4. Deck Premium
Deck can be used for free. A subscription, Deck Premium, is offered in two lengths: monthly and yearly.
- What it gives. Access to the games marked with a lock in the library, and removal of the daily limits that apply to free play. The daily task is always free, with or without a subscription. What is locked and where the limits sit is shown in the app before you reach them, and may change as the app develops; a change that removes something you have already paid for will not be applied inside a period you have paid for.
- Price and payment. The price is the one shown on the subscription screen inside the app, in your store's currency. Payment is charged to your Apple or Google account at confirmation of purchase. We never receive your payment details.
- Renewal. The subscription renews automatically at the end of each period unless it is cancelled at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the end of the current period.
- Cancellation. You cancel in the store, not in Deck: on iOS in Settings, Apple Account, Subscriptions; on Android in Google Play, Payments and subscriptions. Cancelling stops the next renewal and leaves your access running until the end of the period already paid for.
- Refunds. Apple and Google are the sellers of record. Refunds are theirs to give, under their own terms; we cannot issue them, though we will help you make the request. Statutory consumer rights, including any right of withdrawal in the European Union, apply against the seller.
- Price changes. If we change the price, the store will ask you to agree before the new price is charged; if you do not agree, the subscription simply ends at the end of the current period.
5. Games in the app, and games from other people
Deck shows games from three places: those built into the app, those you make or import yourself, and those we publish in the library. We choose by hand what goes into the library.
If you make a game and give it to us for the library, you keep everything you own in it, and you grant us a non-exclusive, worldwide, royalty-free licence to store it, publish it in the app, show its text and rules, and let other people play it. You confirm that the game is yours to give and that it does not infringe anyone's rights. You can ask us to remove it at any time; we will, though copies already downloaded to other devices are beyond our reach.
A game that comes from another person carries their text: its title, its rules in words, the names of its zones. We have no tolerance for objectionable content in that text. What is not allowed, how we moderate it, and how to report it are set out in the Game rules. We may remove any game and refuse anything from its author, without notice, if it breaks those rules.
You are responsible for what you make and for what you pass on. If a game reaches you from someone else, it comes as it is, and we make no promise about it.
6. Other people's rights
We respect copyright and trademarks, and we expect the same. If something in Deck infringes your rights, tell us: the procedure is in Copyright and trademarks below.
7. What we do not promise
Deck is provided as it is. To the extent the law allows, we disclaim all implied warranties, including those of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the app is free of errors, that a game someone else wrote is balanced or winnable, or that the library will always be available.
8. Liability
To the extent the law allows, we are not liable for indirect, incidental or consequential loss, or for lost data. Where liability cannot be excluded, it is limited to the amount you paid us in the twelve months before the event. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot be limited by law, and nothing here takes away rights that consumer law gives you where you live.
9. Ending this agreement
You end it by deleting the app. We may suspend or end your access if you break these terms, and in particular the game rules. Sections 6 to 10 survive the ending.
10. Changes, law, disputes
We may change these terms; the current text always lives at this address with the date of the last change at the bottom. Continuing to use Deck after a change means accepting it. These terms are governed by the law of TODO: страна резидентства владельца. If you are a consumer in the European Union or the United Kingdom, you keep the protection of the mandatory rules of the country you live in, and you may bring proceedings there.
Questions about these terms: support@deckgames.app.
11. Game rules
A game in Deck is a document. It carries its own title, its rules written out in words, and the names of everything on the table — all of it written by a person and read by whoever plays it. These rules say what that text may not contain, what we do about it, and how to tell us.
They apply to every game we publish in the library, and to every game passed from one player to another.
What is not allowed in a game
- Sexual content, and anything sexualising a minor. There is no threshold here and no context that makes it acceptable.
- Hatred, slurs or calls for violence against people because of race, ethnicity, national origin, religion, disability, sex, gender identity, age or sexual orientation.
- Harassment, threats, or a game built to mock or expose a particular person.
- Other people's personal data: names, addresses, phone numbers, photographs, anything that identifies someone who did not agree to be there.
- Gambling with real money or anything pretending to be it: no stakes, no deposits, no payouts, no links to any of that.
- Advertising, links to shops, referral codes, and text whose purpose is to move a player somewhere else.
- Content that infringes copyright or trademarks: the name and artwork of a published game, branded card faces, characters from films or comics. See Copyright.
- Instructions for self-harm, for making weapons, or for anything else illegal.
- Deliberate deception: a game claiming to be an official version of something it is not.
How we moderate
- Before publication. Every game in the library is read by a person before it appears. We publish nothing automatically.
- On a report. Every report is looked at, and we act within 24 hours: we remove the game from the library, or we explain why we did not.
- After the fact. Removal is retroactive: a game already published is removed when we learn it breaks these rules.
- The author. Repeated or egregious breaches mean we accept nothing from that author again.
We can remove a game from the library and stop it reaching anyone new. A copy already downloaded to someone's phone stays on that phone until they delete it — the library is one-way, and we cannot reach into a device. This is worth knowing before you pass a game to someone.
How to report a game
Write to abuse@deckgames.app with:
- the title of the game and, if you have it, the identifier shown on its card;
- where you got it — the library, or another person;
- what is wrong with it, in a sentence;
- a screenshot, if that is quicker.
Reports from inside the app work too: take a screenshot on the game's screen and use the report sheet. It arrives with the technical details already attached.
You will get an answer. Anonymous reports are acted on but cannot be answered.
If a game reaches you from someone else
Games you import are stored on your device and are shown to nobody but you. If one breaks these rules, report it to us at abuse@deckgames.app: if it came from the Deck library we remove it there, so that it stops reaching anyone else, and we stop accepting games from its author.
12. Copyright and trademarks
What we publish
Deck contains classic card games — klondike, freecell, durak and their relatives. The rules of a card game are not owned by anyone: they are a method of play, and methods are not protected by copyright. Names, logos, card artwork and the look of a published edition are a different matter, and those we do not use.
Games in the library are read by a person before they are published, and one of the things that person checks is whether the game leans on someone else's name or artwork.
If we got it wrong
If something in Deck infringes your copyright or your trademark, write to copyright@deckgames.app and include:
- what the work or mark is, and where it is registered or published;
- what exactly in Deck infringes it — the title of the game, and the identifier from its card if you have it;
- your name and contact details, and, if you act for the owner, your authority to do so;
- a statement that you believe in good faith that the use is not authorised;
- a statement that the information you give is accurate.
We answer within 24 hours. If the claim is well founded, we remove the game from the library at once and tell its author why.
If your game was removed and you disagree
Write to the same address. Tell us which game it was, and why you believe the removal was a mistake. If we agree, we publish it again and say so.
Our own rights
The name Deck, the app, its code, its interface, its card artwork and its animations belong to TODO: имя владельца как в документах — оно попадёт в App Store ЕС по DSA and are not for reuse without permission. Games you build in Deck are yours: what you grant us by giving one to the library is described in the Terms of Use, section 5.
